TERMS AND CONDITIONS OF THE PROGRAM GoX

1. General Information

1.1. The customer loyalty program GoX (hereinafter the "Program") is organized and provided in Greece by the societe anonyme under the name "COSMOS SPORT Societe Anonyme Commercial, Hotel and Tourist Company" and the distinct title "COSMOS SPORT S.A.", based in Heraklion, Crete, at 148, 62 Martiron Ave., P.C. 71304, with VAT No. 094259148 and G.E.MI. (General Electronic Commercial Registry) number 077109427000 (hereinafter the "Company", "CosmosSport", "we" or "our"). The Company operates stores under the brand CosmosSport/ Sneaker10/ Rundome/ Slamdunk in Greece.

1.2. By registering and/or participating in the Program, you accept these Terms and Conditions, as applicable from time to time.

1.3. These Terms govern exclusively your participation in the loyalty Program and do not replace or limit the other terms of use of the website, the terms of purchase, the return policy or the privacy policy, which apply concurrently, as the case may be.

2. What is GoX

2.1. GoX is a customer loyalty program, through which participants can collect reward points called GoX from purchases and/or promotional activities and redeem them on future purchases, according to these Terms.

2.2. GoX is a non-monetary reward benefit. It is a reward in the form of a discount for redemption on future purchases. It does not constitute electronic money, a bank deposit, a withdrawable credit balance, or any independent financial claim against the Company.

2.3. The Program is available through the channels designated by the Company from time to time, such as indicatively through the Greek website https://www.rundome.gr/en/ (Rundome Greece), the customer account, and/or in physical stores participating in the Program.

3. Right of Participation

3.1. Natural persons who have completed their 18th year of age and have full legal capacity have the right to participate in the Program. For natural persons who have completed their 16^th year of age, parental consent must have been obtained, under the responsibility and care of the natural person.

3.2. Participation is personal, free of charge, and intended exclusively for private/consumer use. Participation for the purposes of resale, commercial exploitation, or abuse of the Program is not permitted.

3.3. The Company may refuse registration, suspend, or delete a participant's account if it detects a violation of these Terms, provision of false information, fraudulent or abusive behavior, or use of the Program in violation of the law.

4. Registration and Account

4.1. Participation in the Program requires the creation or maintenance of an active customer account and the provision of the information requested during the registration process.

4.2. The participant is obliged to provide accurate, true & updated information and to inform the Company of any changes.

4.3. The participant is responsible for maintaining the confidentiality of their account access credentials and for any activity that takes place through it, unless they prove that it is due to reasons not attributable to their sphere of responsibility.

5. Earning GoXCashback

5.1. GoXcashback is awarded on product purchases and/or in special promotional actions determined by the Company on a case-by-case basis.

5.2. The Company determines from time to time:

• the percentage or method of calculating GoXcashback,
• the categories of products or transactions that are excluded,
• the point in time at which GoXcashback becomes available for use,
• any special restriction or condition associated with a specific action.

5.3. Unless explicitly stated otherwise, GoXcashback:

• is not awarded on shipping costs, gift wrapping, or other additional charges,
• is not awarded on gift cards or other categories of products or services that the Company may exclude from time to time,
• is not awarded on transactions that are canceled, not completed, or suspected of fraud or abuse.

5.4. In the event of a full or partial return of products, cancellation of a purchase, or refund, the Company reserves the right to deduct the corresponding GoXcashback awarded and/or used in connection with that specific purchase. If the relevant GoXcashback has already been redeemed, the Company may offset the corresponding amount from future GoXcashback and/or deduct it from any refund.

6. Redeeming GoX cashback

6.1. Available GoXcashback can be redeemed exclusively on eligible future purchases from the participating sales channels provided that 14 calendar days have passed since the purchase and up to 90 % of the purchase value , according to the terms in force at the time of redemption.

6.2. The Company may set:

• a minimum purchase amount for redemption,
• a maximum amount of GoXcashback per transaction, which is set at €100. Any remaining GoXcashback can be redeemed in a subsequent transaction.
• excluded product categories,
• time restrictions or other reasonable terms of use.

6.3. GoXcashback:

• is not exchangeable for cash,
• is not paid out in case of account cancellation or Program termination, except to the extent explicitly provided otherwise in these Terms,
• is not transferred, sold, or assigned to third parties.

7. Validity Period of GoXcashback

7.1. Unless otherwise specified at the time of award, GoXcashback is valid for a period of six (6) months from the date it becomes available for use. Upon the expiration of the 6 months , GoXcashback ceases to be valid.

7.2. After the expiration of the above period, the unused GoXcashback expires automatically and is deleted, without giving rise to any obligation for compensation or financial payment by the Company.

7.3. The Company may, at its absolute discretion, extend the validity of GoXcashback for specific actions or member categories, provided this is explicitly announced.

8. Promotions, Bonuses, and Contests

8.1. The Company may occasionally organize special promotions, bonus multipliers, boosts, contests, raffles, or other campaigns within the framework of the Program.

8.2. Each such action may be governed by specific terms, which will be published on a case-by-case basis and will prevail in case of conflict with these general terms, only with respect to the specific subject matter they regulate.

9. Prohibited Use – Abuse

9.1. Any use of the Program that is contrary to good faith, its purpose, or the law is prohibited, including but not limited to:

• creating multiple accounts for the same person for the purpose of unfair gain,
• using automated means, scripts, bots, or technical interventions,
• submitting false or misleading information,
• commercial disposal, resale, or exchange of GoXcashback or Program privileges,
• abusive return of products or manipulation of promotional activities.

9.2. In case of suspected or confirmed fraud, abusive practice, violation of these Terms, or illegal use, the Company reserves the right to:

• temporarily suspend or terminate participation,
• cancel GoXcashback that has been awarded and/or redeemed,
• refuse the granting of Program benefits,
• take any other legal measure to protect its interests.

10. Modification or Termination of the Program

10.1. The Company reserves the right to amend these Terms, the features of the Program, the method of calculating or redeeming GoXcashback, eligible purchases, and/or any other operational element of the Program, for important commercial, technical, operational, or legal reasons.

10.2. Any material modification will be communicated in an appropriate manner through the website and/or the member's account before it enters into force, unless immediate application is required for reasons of regulatory compliance, security, or fraud prevention.

10.3. The Company may suspend or permanently terminate the Program. In the event of permanent termination, reasonable efforts will be made to provide prior notice and, where practically feasible, a reasonable period to utilize non-expired GoXcashback.

10.4. Continued participation in the Program after the modifications take effect implies acceptance of the new terms.

11. Withdrawal from the Program

11.1. The participant may withdraw from the Program at any time by submitting a relevant request through the available customer service channels.

11.2. Upon withdrawal or deletion from the Program, any available and unused GoXcashback is deleted, unless otherwise mandatory provided by applicable law.

12. Personal Data

12.1. The Company processes the personal data of the Program participants in accordance with Regulation (EU) 2016/679 (GDPR) and the applicable Greek and Union legislation on the protection of personal data. The principles of transparency, information, and exercise of rights are enshrined in Articles 12 and 13 of the GDPR, while the Hellenic Data Protection Authority explicitly refers to this applicable framework.

12.2. The data necessary for participation and operation of the Program are used for:

• creating and managing a member account,
• awarding and redeeming GoXcashback,
• customer service and complaint management,
• fraud prevention and Program security,
• compliance with the Company's legal obligations.

12.3. Where required by law, the Company will request separate consent for the purposes of commercial communication or other processing that is not necessary for the execution of the Program.

12.4. For more information regarding the processing of personal data, categories of data, legal bases for processing, recipients, retention periods, and your rights, please refer to the Company's Privacy Policy.

13. Limitation of Liability

13.1. To the maximum extent permitted by applicable law, the Company, its affiliated persons, employees, partners, or agents are not liable to the participant for any direct, indirect, incidental, special, or consequential damage, including but not limited to loss of profits, loss of opportunities, loss of data, or loss of anticipated benefits, which may arise from or in connection with:

• participation or inability to participate in the Program,
• the use or inability to use GoXcashback,
• the temporary or permanent suspension or modification of the Program,
• technical malfunctions, system errors, or service interruptions.

13.2. The Company is not liable for damages resulting from:

• force majeure events,
• acts or omissions of third-party providers (e.g., telecommunications providers, internet providers),
• unauthorized use of the participant's account, provided this is not due to the Company's fault.

13.3. The participant bears sole responsibility for the use of their account and for safeguarding their access credentials.

13.4. Nothing in these Terms excludes or limits the Company's liability:

• for damages caused by intent or gross negligence,
• for death or personal injury caused by its act or omission,
• for liability arising from mandatory provisions of law.

13.5. These terms do not affect or limit consumer rights provided by the applicable Greek and Union consumer protection legislation, including in particular the provisions on general terms of transactions and unfair commercial practices, as they apply from time to time.

14.2. The Company will make a reasonable effort to review each request within a reasonable time and in accordance with applicable law.

15. Applicable Law and Jurisdiction

15.1. These Terms are governed by Greek law.

15.2. For any dispute that may arise from or in connection with the Program, the competent courts are the courts of the consumer's domicile or residence, where this is imposed by mandatory provisions of law, otherwise the competent courts of Athens.

16. Final Provisions

16.1. If any term is deemed invalid, voidable, or unenforceable, the validity of the remaining terms is not affected.

16.2. Any tolerance by the Company regarding a breach of a term does not constitute a waiver of its relevant right.

16.3. These Terms constitute the entire agreement governing participation in the Program, except for any specific terms published for specific actions.
